An exclusive contract, like any other contract, regulates the cooperation between two (or more) contracting parties. In the fashion world, by concluding such a contract, the model guarantees that she will only be available to a single contractual partner for a precisely defined period of time.
Companies are usually very interested in exclusive contracts because they make the model inaccessible to the competition. The high recognition value of the advertising face serves solely to promote their own brand. From a marketing perspective, this is an extremely desirable scenario.
Advertising campaigns are usually designed for a very specific period of time. If the model is bound to the client by an exclusive contract for exactly that period of time, this is known as campaign exclusivity.
Model contracts regulate the cooperation between a model and a contractual partner. As far as exclusive contracts are concerned, this partner is either a client directly or an intermediary model agency.
Model & client: If a client wants to win an advertising face all for himself and for his brand, he offers the model an exclusive contract. For the duration of the contract, the model cannot advertise for other brands. The recognition value with the client's brand increases enormously. All relevant questions are clarified between model and client - without an intermediary.
Model & model agency: According to German law, the conclusion of such an exclusive contract is actually illegal. It would only be legal if the agency could guarantee the model a fixed sum of money for the duration of the contract - i.e. a monthly salary. In practice, however, this is not feasible.
Unfortunately, many agencies continue to offer (especially young) models these one-size-fits-all solutions in order to be able to act as a so-called mother agency. This approach is perfectly understandable from the model's point of view. If a model is represented by several agencies, the client always chooses the provider with the best price. This leaves the model with less money at the end of the day.
However, a contract for dedicated exclusive representation by a single agency is illegal. However, no one forces a model to sign contracts with more than one agency. If she feels that she is in good hands with one contractual partner, she can work exclusively with that agency without any problems.
Finding your way in the model scene as a young model is not that easy. The decision for or against an exclusive contract can have a major impact on the progress of your career. At Jobwork you will find all the important information about this special topic.
The conclusion of an exclusive contract entails significant restrictions for a model in terms of potential business partners. However, these limitations are usually more or less compensated for by particularly high fees. An exclusive contract is therefore particularly useful with regard to the model's fee.
